GAME Terms of Service

These GAME Terms of Service govern your use of the Blue Tees Golf GAME mobile application and related services provided by Blue Tees Enterprises LLC d/b/a Blue Tees Golf.

GAME is distributed through the Apple App Store and Google Play. Your licence to install and run the application is granted under the applicable platform's own terms — Apple's Licensed Application End User Licence Agreement or Google Play's terms. These Terms of Service govern your relationship with Blue Tees Golf for the GAME service itself, and do not replace those platform terms.

GAME Premium subscriptions are governed by our GAME Subscription Terms. POST GAME is governed by the POST GAME Terms of Service.

1. Acceptance

By downloading, installing, accessing or using GAME, or by creating a GAME account, you agree to these Terms of Service, to our Terms & Conditions and to our Privacy Policy. If you do not agree, do not use GAME.

2. Eligibility

You must be at least 13 years old to create a GAME account, and at least 18 years old, or the age of majority where you live, to purchase a GAME Premium subscription. If you are under 18 you may use GAME only with the involvement of a parent or guardian who agrees to these Terms of Service. GAME is not directed to children under 13 and we do not knowingly collect personal information from them.

3. Your GAME account

You need an account to use most GAME features. Provide accurate information, keep it current and keep your credentials secure. You are responsible for activity under your account. Tell us at support@blueteesgolf.com if you suspect unauthorised use.

YOU CAN DELETE YOUR GAME ACCOUNT AT ANY TIME FROM WITHIN THE APPLICATION. Deleting your account is permanent and removes your account and associated data as described in our Privacy Policy.

Deleting your account is a different action from cancelling a paid subscription, uninstalling the app, or unsubscribing from marketing. IF YOU HAVE A PAID SUBSCRIPTION, DELETING YOUR ACCOUNT DOES NOT AUTOMATICALLY CANCEL BILLING — cancel your subscription first. See GAME Subscription Management.

4. Free and premium features

GAME offers a free tier and an optional paid GAME Premium subscription. Premium features may include Scout AI and other AI-powered functionality, personalised recommendations, advanced shot tracking, post-round analytics, USGA score posting, leaderboards and additional GPS and course intelligence features.

Which features sit in which tier may change as we develop the product. Subscription pricing, billing, renewal, cancellation and refunds are governed exclusively by our GAME Subscription Terms.

5. Connected Blue Tees Golf hardware

GAME connects to compatible Blue Tees Golf devices, including rangefinders, GPS speakers, GPS handhelds, wearables and launch monitors, usually over Bluetooth.

Connectivity depends on your device, operating system, permissions, network and the hardware itself, and is not guaranteed. Supported hardware changes over time, and we may end support for older devices or firmware. We may deliver firmware or software updates through GAME, and some updates are required for continued functionality or security. Your use of connected hardware is also governed by the product manual and by our Two-Year Limited Warranty.

6. Location and GPS

GAME requires access to your device's location to deliver core functionality including distances, course detection and shot tracking, and may use precise location and Bluetooth. You control these permissions through your device settings, and withdrawing them will disable features that depend on them.

How we collect and use location data is described in our Privacy Policy. Precise geolocation is treated as sensitive personal information under California law and you may limit its use as described in Your Privacy Choices.

7. Accuracy — please read

(a) MEASUREMENT AND GPS. Distances, positions, elevations, environmental readings and performance figures produced by GAME and by connected hardware are APPROXIMATE. Accuracy is affected by satellite availability, weather, terrain, obstruction, technique, device condition, battery level, calibration and connectivity. NO FIGURE PRODUCED BY GAME IS GUARANTEED TO BE ACCURATE. Your club selection and shot decisions are your own.

(b) COURSE DATA. Course maps, hole layouts, hazard and pin positions and related data come from third-party and public sources and may be incomplete, outdated or wrong. Course conditions change. We do not warrant course data.

(c) SCORES AND HANDICAP. Score posting and any handicap-related output depend on the accuracy of what you enter and on third-party systems including the USGA. We do not warrant that any score, differential or index calculated or transmitted through GAME is accurate or accepted by any governing body. You remain responsible for the accuracy of scores you post.

(d) COMPETITIVE PLAY. Rules on distance-measuring and performance devices vary by governing body, competition and local rule. IT IS YOUR RESPONSIBILITY TO CONFIRM WHETHER GAME, ANY CONNECTED DEVICE, OR ANY PARTICULAR FEATURE IS PERMITTED IN A COMPETITION YOU PLAY IN. We are not responsible for any penalty or disqualification.

(e) SAFETY. Do not operate GAME or any connected device in a way that distracts you from your surroundings, from play, or from operating a vehicle or cart.

8. AI-powered features

GAME includes AI-powered functionality, which may include Scout AI, automated club and strategy recommendations, and generated insights about your play.

THESE FEATURES ARE INFORMATIONAL ONLY. They are produced by automated systems from incomplete data, may be inaccurate, incomplete or unsuitable for your situation, and are not advice or a guarantee of any outcome. THEY ARE NOT A SUBSTITUTE FOR YOUR OWN JUDGEMENT, AND YOU REMAIN SOLELY RESPONSIBLE FOR EVERY DECISION YOU MAKE ON THE COURSE.

AI features depend on third-party technology and may be modified, limited or discontinued at any time. Outputs are generated for you individually and may differ between users and between rounds on identical inputs.

We may use round, shot and performance data in aggregated or de-identified form to operate, evaluate and improve GAME and its features, as described in our Privacy Policy. We do not use it in a form that identifies you for that purpose.

9. Your data and content

You retain ownership of the rounds, scores, statistics, photographs, notes and other content you create in GAME ("Your Data").

You grant Blue Tees Golf a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit and display Your Data as necessary to operate and provide the GAME service to you, to support you, and to develop and improve our products and services. Where you choose to share content publicly, for example on a leaderboard or in a shared round, you grant us a licence to display it in that context.

We are not a backup service. Keep your own copy of anything you cannot afford to lose.

10. Acceptable use

You must not: use GAME unlawfully; reverse engineer, decompile or attempt to derive source code except where that restriction is unenforceable by law; interfere with or circumvent security, rate limits or access controls; access GAME by automated means or scrape data from it; submit false scores or manipulate leaderboards, statistics or handicap data; use GAME to harass any person; resell, sublicense or commercially exploit GAME or its data; or use GAME or its outputs to build a competing product or service.

11. Third-party services

GAME integrates third-party services including Apple, Google, mapping and course data providers, the USGA, analytics providers and AI technology providers. We do not control them and are not responsible for their availability, content or practices. Your use of a third-party service may be subject to that provider's own terms.

12. Availability and changes

We may add, change, suspend or discontinue GAME features at any time, and may impose limits on features or storage. We aim to keep GAME available but do not guarantee uninterrupted or error-free operation. Where a change materially reduces the core functionality of a paid plan, the remedy is set out in our GAME Subscription Terms.

13. Suspension and termination

We may suspend or terminate your access to GAME if you breach these Terms of Service, our Terms & Conditions or our GAME Subscription Terms, if we suspect fraudulent, abusive or unlawful activity, or if required by law. You may stop using GAME at any time and may delete your account in the application. Sections that by their nature should survive termination will do so.

14. Intellectual property

GAME, including its software, interface, design, content, data compilations, trademarks and the outputs of its AI features, is owned by or licensed to Blue Tees Golf and protected by intellectual property laws. Subject to these Terms of Service you receive only a limited, revocable, non-exclusive, non-transferable right to use GAME for your personal, non-commercial purposes. All other rights are reserved.

15. Disclaimers and limitation of liability

GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT GAME WILL BE UNINTERRUPTED, SECURE, ERROR-FREE OR ACCURATE.

The limitation of liability in Section 22 of our Terms & Conditions applies to these Terms of Service. Nothing here limits liability that cannot be limited by law.

16. Apple and Google

The following applies to the extent you obtained GAME through the Apple App Store or Google Play.

  • These Terms of Service are between you and Blue Tees Golf only, not with Apple or Google.
  • Blue Tees Golf, not Apple or Google, is solely responsible for GAME and its content.
  • Apple and Google have NO OBLIGATION TO PROVIDE MAINTENANCE OR SUPPORT for GAME.
  • If GAME fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the application where applicable. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to GAME.
  • Blue Tees Golf, not Apple or Google, is responsible for addressing any claim by you or a third party relating to GAME, including product liability claims, claims that GAME fails to conform to a legal requirement, and claims under consumer protection or privacy law.
  • Blue Tees Golf, not Apple or Google, is responsible for investigating and defending any third-party claim that GAME infringes intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • APPLE AND GOOGLE, AND THEIR SUBSIDIARIES, ARE THIRD-PARTY BENEFICIARIES OF THESE TERMS OF SERVICE AND MAY ENFORCE THEM AGAINST YOU.

17. Dispute resolution

The dispute resolution and arbitration provisions in Section 20 of our Terms & Conditions, including the class action waiver and your 30-day right to opt out, apply to any dispute arising out of or relating to GAME or these Terms of Service.

18. Changes to these Terms of Service

We may update these Terms of Service. If a change is material we will give reasonable notice in the application, by email, or both. Continuing to use GAME after the effective date means you accept the change.
